Aerflo Limited 1-Year Warranty


Your Aerflo™ Aer1 System (“Product”) includes a one (1) year limited warranty from the date of purchase (“Warranty Period”) against defects in materials and workmanship. This is the only express warranty for this product and is in lieu of any other warranty or condition. 


 Aerflo will repair or replace your product free of charge on the following conditions:

  1. Products returned under this warranty must be accompanied  by a description of the defect together with a copy of your proof of purchase and your full contact information and delivery details: name, telephone, email address, and complete mailing address.
  2. Products returned to Aerflo must be adequately packaged. Aerflo will accept no liability for goods lost or damaged in transit from the customer.
  3. Products must have been used strictly in accordance with the instructions supplied. Aerflo will have no liability for defects caused by accident, mis-use, alteration or neglect. Common examples of mis-use include, but are not limited to, exposure to elevated temperatures, heat, hot liquids, dishwashers, or use with liquids other than plain water, bottles other than the Aerflo Aer1 Bottle or other compatible bottles as directed by AerfloAerflo accepts no liability for any consequential loss, damage, or expense of any kind resulting from the Products or its accessories or the use thereof.
  4. This Product is designed for use only with Aerflo Carbon Capsules and with Aerflo Aer1 Bottles or other compatible bottles as directed by Aerflo. This warranty does not cover any malfunction or damage caused by the use of third party CO2 products or with other non-compatible water bottles. Refer to aerlfo.co/compatible for more information. 

The Warranty does not apply to: 

  1. cosmetic damage, including but not limited to scratches and dents; 
  2. damage caused by external cause, including but not limited to accident, abuse, misuse, hot water or heat; 
  3. damage caused by operating or use of the Product other than in accordance with applicable guidelines from Aerflo, including the Product’s user manuals, technical specifications, etc.; 
  4. a Product that has been modified; or 
  5. defects caused by normal use or otherwise due to the normal ageing.

The Warranty is in addition to, and not instead of, any rights you have under applicable consumer protection regulations and laws. You as a consumer always have the right to choose whether to claim service under the Warranty or to claim service from the original seller of the Product in accordance with your  rights under the law.. All conditions and other terms not set out in the Warranty are excluded from the Warranty. 

In no event shall Aerflo under this Warranty be liable for any losses or damages related to the defects in materials and workmanship of the Product, whether foreseeable or not.

The limitation of liability of the Warranty shall not apply to (a) death or personal injury; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded as a matter of law.

If any term or condition set out in this Warranty is held to be illegal or unenforceable in any state, it shall be severed from the Warranty and the legality or enforceability of the remaining terms shall not be affected.

This warranty gives you specific legal rights, and you may also have other rights which vary form state to state. 

Jurisdiction

This Warranty shall be construed and enforced in accordance with the laws of the State of New York, without regard to any conflict of law provisions. The waiver of any provision of this Warranty shall not be considered a waiver of any other provision or of our right to require strict observance of each of the terms herein. If any provision of this Warranty is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect.

Dispute Resolution

In the event of any controversy, claim, action or dispute arising out of or related to this Warranty, or the breach, enforcement, interpretation, or validity of this Warranty ("dispute"), the party asserting the dispute shall first try in good faith to settle such dispute by providing written notice to the other party by registered mail describing the facts and circumstances (including any relevant documentation) of the dispute, and allowing the receiving party not less than 30 days from the date of mailing to respond to the dispute. Notice sent to us shall be sent to the address stated below.

In the event that the parties are unable to resolve the dispute, the parties agree that the dispute shall be settled utilizing binding arbitration, which shall be adjudicated by the Judicial Arbitration and Mediation Services, Inc. (“JAMS”) for binding arbitration under its rules then in effect in New York before one arbitrator to be mutually agreed upon by both parties. Arbitration shall proceed solely on an individual basis without the right for any claims to be arbitrated on a class action basis. You hereby waive your right to a class action lawsuit.

Claims under the Registered Warranty

If your Product becomes defective during the Warranty Period, you are kindly asked to contact Aerflo via our Customer Support. After receipt of your claim, a representative for Aerflo will contact you and may ask for further information, including photos of the defective Product.

If Aerflo, in its sole discretion, finds that you have submitted a valid claim under the Warranty, Aerflo will, at its option either (a) repair your Product or (b) replace your Product with a product that is at least functionally equivalent to the Product.

In case of repair or replacement of the Product, Aerflo kindly asks you to follow the instructions given, which may include that you are to arrange for the return of the original Product following a set of instructions provided by Aerflo.

Aerflo will always arrange and pay the expenses for returning a repaired Product to you (at an address in the contiguous USA) or providing you with a replacement product.

A repaired Product or a replacement product either substitutes the original Product in relation to the remaining Warranty or provides you an additional Warranty during ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you.
